The Asbestos Hazard Emergency Response Act (AHERA) requires public school districts and non-profit private schools, including charter schools and schools affiliated with religious institutions, to develop, implement, and maintain a Management Plan for asbestos-containing materials (ACM) in their buildings. The purpose of the plan is to ensure the safety of students and staff by managing the presence of asbestos effectively.
Here’s a breakdown of the AHERA Management Plan Administration as administered by Detail Associates, Inc.
1. Designated Person
Detail Associates has performed a function of as a Designated Person who is responsible for ensuring compliance with AHERA regulations. We are overseeing the implementation and updating of the asbestos management plan.
2. Inspection and Re-inspection
Re-inspection: Every six months and every three years, we re-inspect known or assumed ACM to monitor its condition.
3. Management Plan
Management Plan, which includes:
- Inspection reports: Details on the locations and conditions of ACM.
- Response actions: Information on actions taken to prevent asbestos exposure, such as repairs, removal, or maintenance.
- Operations and Maintenance (O&M) Program: Procedures for managing ACM safely during daily operations, including regular cleaning and maintenance protocols.
- Periodic Surveillance: Conduct periodic (at least every six months) surveillance of ACM to check its condition.
- Training: Custodial and maintenance staff must be trained in asbestos awareness and handling procedures if they may disturb asbestos materials.
- Notifications: Annual notifications to parents, teachers, and employees about the availability of the asbestos management plan and the status of asbestos activities in the school.
- Recordkeeping: Detailed records of all inspections, training, maintenance, and response actions related to asbestos must be kept for the life of the building.
4. Response Actions
Schools are required to take appropriate response actions to address ACM when it is damaged or deteriorating.
These actions could include:
- Repair: Encapsulation or enclosure of the material to prevent fiber release.
- Removal: Complete removal of ACM in high-risk areas, often during renovation or demolition.
- Maintenance: Continuing regular maintenance and monitoring to ensure the material remains undisturbed and in good condition.
5. Annual Notification
Schools are required to notify staff and parents annually about the presence of ACM and the steps being taken to manage it safely. The notification must inform them of the availability of the asbestos management plan for public review.
6. Documentation and Reporting
The management plan must be available for public inspection during regular school hours. Additionally, schools must report any significant changes related to asbestos management, including the results of inspections and any abatement actions taken.
The goal of the AHERA Management Plan is to protect the health and safety of students, staff, and building occupants by ensuring that asbestos is effectively managed in school facilities. Schools must ensure strict compliance with all the AHERA requirements and maintain transparency with all stakeholders.
